Jail term upheld for faulty breast implants company boss

The founder of a company that made faulty breast implants has had a four-year jail sentence upheld by a French appeals court. Jean-Claude Mas, 76, was also fined 75,000 euros and was banned for life from working in medical services or running a company. He was allowed to go free pending another appeal. The scandal over abnormally high rupture rates in PIP implants emerged five years ago, affecting hundreds of thousands of women in dozens of countries.

A churchgoer shot a fellow parishioner in a Pennsylvania church after a fight broke out over a seat in the sanctuary on Sunday, authorities say. An Italian art detective claims that Leonardo da Vinci used both a female and a male model to create the face of one of the world's most famous paintings, the 'Mona Lisa'. He says the first model was Lisa Gherardini, known as Mona Lisa del Giocondo, and his second model was his long-time apprentice and lover, Gian Giacomo Caprotti, known as Salai. Silvano Vinceti, head of the research group the National Committee for Cultural Heritage, based his findings on infra-red examinations of the Mona Lisa. "There is one indisputable element of proof which can be seen, with the use of infrared technology, in the first layer of the painting of Mona Lisa," he explains. "In that layer we can see that she was not smiling and joyful but looked melancholic and sad." Story has it that Gherardini looked sad at the sittings and her husband, a Florentine silk merchant who had commissioned the painting, hired clowns to try to make her smile. His efforts failed and Leonardo had to use another model to satisfy her husband's requests. The investigative team compared Salai's features from other Leonardo paintings to those of the Mona Lisa. "We have used all the paintings in which Leonardo used Salai as a model and compared them to the Mona Lisa and certain details correspond perfectly," says Silvano Vinceti. "So, he used two models and then added creative details, that came from his own imagination. I believe that this goes with a long-time fascination of Leonardo's, which was the subject of androgyny. In other words, for Leonardo, the perfect person was a combination of a man and a woman." What's believed to be the remains of Lisa Gherardini were discovered last year by researchers excavating under a centuries-old convent in Florence. The bones, which included a femur, are believed to date back to around the time she died, in July 1542, at the age of 63.

The number of people facing hunger in Zimbabwe due to drought has risen from three to four million, according to estimates. The UN children's agency UNICEF says the poor southern African country is experiencing the worst drought in two decades - induced by a powerful effect from El Nino. Earlier this year UNICEF warned that malnutrition was taking hold, with nearly one million children in eastern and southern Africa in need of treatment for acute malnutrition. Water is also scarce in Zimbabwe. Women - the main care givers in many families - have to walk for long distances in search of supplies. "The distance we have to cover to get to water is great. The Free Syrian Army militant group has refused to recognize partial ceasefires and stated that if the UN-backed truce is not implemented in full, the militant group can claim a right to withdraw from the Geneva talks and respond to attacks. The shaky coalition of militant groups, united under the US-backed umbrella organization dubbed the FSA, issued an official statement on May.1. The FSA also rejected the US and Russia-brokered "regime of silence" which is currently in place in parts of the provinces of Damascus and Latakia since the midnight on Friday. The regime of silence was expected to last for 72 hours. FSA militants accused Damascus of violating the ceasefire in Syria and said they "appreciate the position of the High Negotiations Committee on suspension of the Geneva-3 talks and support it." We remember, the Geneva-3 talks were, de-facto, sabotaged by representatives of the HNC, which promote interests of the Turkish-Saudi block. The Salafi militants of Jaysh al-Islam and Ahrar ash-Sham, which represented on the talks, played a crucial role in this sabotage, making attempts to advance in the Latakia province and shelling residential areas of Aleppo City and Damascus. The so-called Syrian opposition, mainly a diverse range of rebranded Islamist militants, is dissatisfied that Al Nusra, the main striking force of the Salafists in Syria, was recognized as a terrorist group and excluded from the negotiations. Meanwhile, Al Nusra remains in alliance with the internationally recognized oppositioneers as Ahrar ash-Sham, via the joint operational room, called Jaish al-Fatah. In turn, Ahrar ash-Sham, Jaysh al-Islam and the FSA set a joint operational room, called Rad al-Mazalem, in order to coordinate military actions in Aleppo. Indeed, it's hardly possible to divide the so-called "opposition" from the terrorists in Northern and Central Syria. Countering military provocations of terrorists, the Syrian government is pushed to conduct counter-terrorism operations. The HNC argue these operations violate the ceasefire. For example, on May 1, Syria's forces continued operations in the areas near the Syrian capital, Damascus. The Syrian Arab Army (SAA) and its allies took control of the village of al-Rukabiyah following a day of clashes with the Islamists. Hezbollah fighters reportedly supported the SAA units in this operation. The al-Rukabiyah village had been under the control of Al Nusra and Jaish al-Islam. Some units of these groups are still operating in the nearby areas. Thus, the close cooperation of different armed opposition groups with the terrorist undermines the idea of the peaceful solution of the conflict.

The Islamic State of Iraq and Al-Sham (ISIS) launched a powerful offensive at the Al-Sha'ar Gas Fields on Monday morning that targeted wells 101, 103, and 105 under the Syrian Arab Army's (SAA) control. ISIS began the assault by launching their usual VBIED (vehicle borne improvised explosive device) at the Syrian Arab Army's defenses in the vicinity of Well 105; this terrorist attack was halted before it could reach its intended target. Following the VBIED attack, ISIS stormed the southern perimeter of the Al-Sha'ar Gas Fields, resulting in a fierce battle with the Syrian Arab Army. Palestinian leaders have condemned the Eurovision Song Contest for its decision to prevent their flag from being flown during the annual event later this month. The document in the American Archives, reporting the widespread famine and spread of epidemic disease in Iran, estimates the number of the deceased due to the famine to be about 8-10 million during 1917-19, making this the greatest genocide of the 20th century and Iran the biggest victim of World War I. It should be noted that Iran had been one of the main suppliers of food grains to the British forces stationed in the empire's South Asian colonies. Although bad harvest during these two years made the situation worse, it was by no means the main reason why the Great Famine occurred. Prof. Gholi Majd of Princeton University writes in his book, The Great Famine and Genocide in Persia, that American documents show that the British prevented imports of wheat and other food grains into Iran from Mesopotamia, Asia, and also the USA, and that ships loaded with wheat were not allowed to unload at the port of Bushehr in the Persian Gulf. Professor Majd argues that Great Britain intentionally created genocide conditions to destroy Iran, and to effectively control the country for its own purposes. Major Donohoe describes Iran of that time as a "land of desolation and death". But this event soon became the subject of a British cover up. Britain has a long record of its several attempts to conceal history and rewrite it in their own favor. The pages are filled with conspiracies that were covered up by the British government to hide its involvement in different episodes that would tarnish the country's image. One of the clear examples is the "Jameson Raid"; a failed coup against Paul Kruger's government in South Africa. This raid was planned and executed directly by the British government of Joseph Chamberlain under the orders of Queen Victoria. In 2002, Sir Graham Bower's memoirs were published in South Africa, revealing these involvements that had been covered up for more than a century, focusing attention on Bower as a scapegoat for the incident. The records that were destroyed to cover up British crimes around the globe, or were kept in secret Foreign Office archives, so as to, not only protect the United Kingdom's reputation, but also to shield the government from litigation, are indicative of the attempts made by the British to evade the consequences of their crimes. The papers at Hanslope Park also include the reports on the "elimination" of the colonial authority's enemies in 1950s Malaya; records that show ministers in London knew of the torture and murder of Mau Mau insurgents in Kenya and roasting them alive. These records may include those related to Iran's Great Famine. Why were these records that cover the darkest secrets of the British Empire destroyed or kept secret? Simply because they might 'embarrass' Her Majesty's government. A famine occurred in Ireland from 1845 until 1852 which killed one fourth of the Irish population. This famine was caused by British policies and faced a large cover up attempt by the British government and crown to blame it on 'potatoes'. The famine, even today, is famous in the world as the "potato famine" when, in reality, it was a result of a planned food shortage and thus a deliberate genocide by the British government. The true face of this famine as a genocide has been proven by historian Tim Pat Coogan in his book The Famine Plot: England's Role in Ireland's Greatest Tragedy published by Palgrave MacMillan. A ceremony was planned to take place in the US to unveil Coogan's book in America, but he was denied a visa by the American embassy in Dublin. Therefore it becomes obvious that Britain's role in Iran's Great famine, which killed nearly half of Iran's population, was not unprecedented. The documents published by the British government overlook the genocide, and consequently, the tragedy underwent an attempted cover-up by the British government. The Foreign Office "handbook on Iran" of 1919 mentioned nothing related to the Great Famine. Julian Bharier, a scholar who studied Iran's population, built his "backward projection" estimation of Iran's population based on reports from this "handbook" and, as a result, ignored the effect of the Great Famine on Iran's population in 1917. Bharier's estimations were used by some authors to deny the occurrence of the Great Famine or to underestimate its impacts. By ignoring Iran's Great Famine in his estimations, Bharier's work faces four scientific deficiencies. Bharier does not consider the loss of population caused by the famine in his calculations; he needs to 'adjust' the figure of the official census in 1956 from 18.97 million to 20.37 million, and this is despite the fact that he uses 1956 census as his primary building block for his "backward projection" model. He also ignores the official growth rates and uses his personal assumptions in this regard, which is far lower than other estimates. Finally, although Bharier frequently cites Amani's estimates, in the end Bharier's findings contradict that of Amani's; notably Bharier's population estimate for 1911 is 12.19 million while Amani put this figure at 10.94 million. Despite deficiencies in the population estimates offered by Bharier for the period of the Famine and its earlier period, his article offers useful data for the post-Famine period; this is because these figures are generated from 1956 backward. That is to say, numbers generated from 1956 to 1919 are thus credible because they do not include the period of famine. Moreover, this portion of Bharier's data are also true to that of the American Legation. For example, Caldwell and Sykes estimate the 1919 population at 10 million, which is comparitive to Bharier's figure of 11 million. Gholi Majd was not the first author to refute Bharier's figures for this period. Gad G. Gilbar, in his 1976 article on demographic developments during the second half of the 19th century and the first decade of the 20th century, also considers Bharier's estimates inaccurate for the period. In an apparently biased review of Majd's work, Willem Floor confirms Bharier's model, despite its apparent deficiencies, and takes a mocking tone toward the well- documented work of Gholi Majd to undermine the devastation caused by the British-instigated famine in Iran, to the point of total denial of the existence of such a genocide. Floor also offers inaccurate or untrue information to oppose the fact that the British deprived Iranians from honey and caviar in the north, as he argues caviar was haram (religiously prohibited), while no such fatwa has ever existed in Shia jurisprudence and all available decrees assert that caviar is halal or permissible under the Islamic law. There was a rumor made up by Russians at the time, saying that Caviar was haram and Britain made full use of this rumor. Another criticism made by Floor was to question why Majd's work does not use British archival sources. A more important question is why Majd should have used these sources when they totally ignore the occurrence of the famine in Iran. 2 May 2016 - European courts appear to be going easy on the UK in the run up to the Brexit referendum because they are scared of provoking voters into choosing to leave the European Union (EU). The number of human rights cases against the British government has dropped by a third since the referendum was called, and the European Court of Human Rights (ECHR) has also sided with Britain in a variety of disputes. The court, based in Strasbourg, heard 1,702 cases against Britain in 2012, but that number dropped to 908 in 2013, after Prime Minister David Cameron announced there would be an EU referendum within four years. That total fell again to 720 in 2014 and then 575 last year - a drop of 66 per cent from 2012. The Daily Mail reports that a number of major judgements also went in Britain's favour during this period, compared to previous years where EU judges condemned the country on issues such as the detention of Al Qaeda militant Abu Qatada, or the shooting of IRA terrorists in Gibraltar. A spokesman for the court denied they were going easy, saying: "The statistics refer to the number of applications allocated to a judicial formation. "The decrease coincides with the ECHR's new stricter approach to what constitutes an application. Stricter conditions for lodging an application have been applied since January 1, 2014." However, UK Defence Minister Julian Brazier said: "The European institutions are going easy on Britain until they see the outcome of the referendum. "The judges are afraid of the restoration of parliamentary sovereignty and control of our own laws." David Campbell Bannerman, who is one of the minority of Conservative MEPs to back Brexit, added: "They have turned the tap off for political reasons. The danger is they will turn it back on again, and if we vote to remain there will be a flood of new court rulings against Britain." 2 May 2016 - Police evacuated more than one thousand people from a makeshift migrant camp near a Paris metro station on Monday, the third time the camp has been cleared in as many months. Shortly after 6am, people who had been staying in the tightly packed tents under an elevated section of the Stalingrad station in the north of Paris began boarding buses to take them to reception centres. The evacuation passed off largely without incident, authorities said. Although only around 500 people had been counted at the camp the night before, police said around 1,350 people had gathered there Monday to be re-located to accommodation centres, suggesting that migrants from other parts of Paris had swelled their numbers. Around 150 police officers were involved in the operation to relocate the migrants, mostly from Sudan and Afghanistan. "We're happy to leave," said Moustafa, a 24-year-old Afghan who had been at the camp for a month. "There were fights every night at the camp." Another Afghan, Abdullah, said he hoped to stay in Paris long-term. "That is where the rest of the community is and there is work here." He said he had given up hope of reaching Britain, the country which many of his compatriots try to reach from France. "It's a good country here," he said. Teen stabbed in Auckland when Tinder date goes wrong

Two teenagers have been charged after a Tinder date ended with a 28-year-old man being stabbed in the chest in West Auckland. A 15-year-old girl has been charged with causing grievous bodily harm with intent to rob following the incident on Friday night. The victim is alleged to have been stabbed in the chest as he sat in a car with the girl, who he'd met on social media dating app Tinder. The victim remains in hospital in a stable condition. The boy has also been charged with being a party to causing grievous bodily harm with intent to rob. He is expected to appear in the Waitakere District Court tomorrow. The victim is believed to have collected a young woman from an address in Massey on Friday night. He was later seen collapsed in the middle of a roundabout at the corner of Triangle Rd and Huruhuru Rd clutching his chest, where people tried to help him. A police spokesman said emergency services arrived on the scene at 11.50pm and the man was taken to Waitakere Hospital by ambulance with a deep cut just below his collar bone. It is understood the man also suffered a collapsed lung. A man who lives near the roundabout said he was woken by a knock on his door by a police officer about 1am but by the time he got up, the officer had walked away. From his window, he could see a number of police cars with their lights flashing and a cordon at the roundabout. Another woman who lived near the scene also woke to police cars but didn't know what happened. "That's scary. Nothing like that has happened near here before."

So, should Morales-Caceres be freed from prison before his life sentence concludes and El Salvador refuses to welcome him back, it's only six months until he's free to haunt American neighborhoods once more. One-fifth of the entire population of El Salvador currently resides in America, according to the Migration Policy Institute.

Last Ringling Circus Elephant has left the building

The final Ringling Bros show with elephants just finished in Providence, Rhode Island . One of the reasons for the retirement of the elephants was local bans on bullhooks such as the one in los angeles.This is the pole with a metal hook on the end to jab and hit the animal with. Without this bullhook the trainers have no way to control the elephant and effectively blocking the circus from operating in that area. While it is great they will not be used in the Circus anymore ,Ringling chose to retire them to their 200 acre florida property instead of a true sanctuary like the 2000 acre Paws Facility in California. At the florida facility the elephants stay chained at night and sleep in a caged area. At Paws in California ,where most zoos have chosen to retire their elephants they can roam free over hills and food is trucked out to them. They have no handlers,no chains and no bullhooks. Ringing has made a deal with a cancer research company to experiment on the elephants and they will continue to breed them. Ringling will still continue to use other animals in their shows such as tigers.

In early 2010, a German Shepherd called Buddy was hailed a hero for guiding an Alaskan State Trooper through winding and remote back roads to a fire at his owner's workshop. Alaskan State Trooper , Terrence Shanigan, was led to the incident by Buddy after his GPS failed. The incident was recorded on Terrence's patrol car dashboard camera, which shows exactly how Buddy managed to help. ANCHORAGE, Alaska -- Alaska State Troopers are presenting a special award to Buddy, a German Shepherd that led authorities to a fire at his owners' property near Willow. Buddy will receive the engraved silver-plated dog bowl Friday afternoon in Anchorage. Troopers say Buddy and his owner, 23-year-old Ben Heinrichs, were in the family workshop on the Caswell Lakes property April 4 when a heater ignited chemicals .Heinrichs, who sustained minor flash burns on his face, dashed out as the fire grew. He then told Buddy "we need to get help." The dog took off and eventually found a trooper responding to a call about the fire. Buddy led the officer through winding back roads to the house and the trooper guided firefighters to the scene. The workshop was destroyed, but only some window trim on the house was damaged.

Kentucky Confederate Monument Removed After 120 Years

Louisville, KY - A Confederate monument will be removed from a spot near the University of Louisville campus where it has stood since 1895. The stone monument honoring Kentuckians who died for the Confederacy in the Civil War will be moved to another location, University President James Ramsey and Louisville Mayor Greg Fischer said during a surprise announcement Friday. The monument is capped with a statue of a Confederate soldier. "It's time for us to move this monument to a more appropriate place," Ramsey said while standing in front of the stone memorial, which sits next to the university's gleaming Speed Art museum that just completed a $60 million renovation. Governments and universities across the country have re-evaluated displays of Confederate symbols following the racially motivated slayings last summer of nine black parishioners at the Emanuel AME church in Charleston, South Carolina. The tall, obelisk-style monument will be disassembled and cleaned while it is in storage awaiting a new location, which has not been determined. It was given to the city by the Kentucky Woman's Monument Association. Ricky Jones, a professor of Pan-African studies at the university, said he has been pushing for removal of the statue since he arrived at the university in the late 1990s. "I can't tell you how happy I am," Jones said after the announcement Friday. "I think this statue being on the campus is somewhat akin to flying the Confederate flag over the (university's) administration building." Jones wrote in a newspaper opinion piece last week that the statue is a "towering granite and bronze eyesore glorifying the nadir of America's past."

PASSIVE AND ACTIVE CRUELTY There are two kinds of animal cruelty inherent across the spectrum of animal abuse. ACTIVE CRUELTY, which is cruelty inflicted (with deliberate intent to harm an animal creating immediate pain and suffering), and PASSIVE CRUELTY (harm inflicted via willful neglect creating prolonged suffering). One or both types are inherent cruelty to companion animals, animals used for research, industrial factory farmed animal cruelty, animals used for sport and ritual, hoarding, animals killed for their fur, skins and body parts and mass market puppy mill production. Regardless of the arguments that it may be the "custom" to ritually slaughter an animal for its fur or skin, or eat the animals we call our companions, cruelty is cruelty and cannot be disguised. All animals killed in these practices are "SENTIENT." They feel excruciating pain, fear and terror. This fact cannot be disregarded. While no regard is paid to this fact in many other countries, as a European and North American society we have a choice and must choose not to support and to condemn this absence of regard. Animal cruelty is no longer a simple issue and categorically cannot be ignored. Animal cruelty issues long considered a peripheral concern are no longer on the outskirts of our society. Clinicians, veterinarians and scientists are starting to see a shift in that mentality now. Animal cruelty is now recognized as signature pathology. The precious animals we see in the media so badly abused are the publicized victim of a phenomenon that a growing number of professionals including police officers, prosecutors, psychologists, social workers, animal-control officers, veterinarians and dogcatchers are now addressing with a newfound vigor: wanton cruelty toward animals. PERPETRATORS OF ANIMAL ABUSE ACTIVE CRUELTY (Acts of Commission) The Link Between Animal Cruelty (Domestic and Other Forms of Violence) This little cat who was named DUTCH was found hanging upside down, nailed by one back leg to a utility post. The fourth edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM) defines conduct disorder as "a repetitive and persistent pattern of behavior in which the basic rights of others or major age appropriate societal norms or rules are violated." Conduct disorder is found in those who abuse animals and abuse people. Clinical evidence indicates that animal cruelty is one of the symptoms usually seen at the earliest stages of conduct disorder, often by the age of eight. This information has only recently been included in the DSM so some psychologists, psychiatrists, and social workers are just now becoming aware of it. Many psychological, sociological and criminology studies in recent decades have clearly shown that violent offenders have adolescent histories of serious and repeated animal cruelty. The F.B.I. has analyzed the lives of serial killers and their findings suggest that most serial killers have killed or tortured animals as children. Further research has shown consistent patterns of animal cruelty among perpetrators of more common forms of abuse such as: child abuse, spouse abuse and elder abuse. FBI Supervisory Special Agent Allen Brantley was quoted as saying, "Animal cruelty is not a harmless venting of emotion in a healthy individual; This is a warning sign." Forced abuse (child is forced into animal abuse by a more powerful individual). Animal phobias. Post-traumatic play (reenacting violent episodes with an animal victim.) Dr. Randall Lockwood, who earned a doctorate in psychology and is senior vice president for anti-cruelty and training for the American Society for the Prevention of Cruelty to Animals, says that children and adolescents who are abusive to animals are often acting out violence experienced or witnessed in their home. Aggressive individuals usually become that way because of a real or perceived injustice. Jeffrey Dahmer, David Berowitz, Ted Bundy, all sadistically tortured animals in their childhood. Brenda Spencer, who opened fire at a San Diego school, killed two students and injured nine other children. When she was young, she had repeatedly abused cats and dogs, often by setting their tails on fire. Up to 75 percent of domestic violence victims report that their partners threatened or killed family pets. Women seeking safety at domestic violence shelters are nearly 11 times more likely to report that their partner has hurt or killed pets than women who have not experienced domestic violence. 48 percent of respondents reported that animal abuse had occurred "often" during the past 12 months. 30 percent reported the abuse occurred "almost always." 51 percent reported that animal abuse incidents coincided with violent outbursts against human family members. 85 percent of the 50 largest shelters for battered women in the United States said clients discussed incidence of pet abuse in the family. OUR SOCIETY As a society we need to be deeply concerned about this issue. A 2009 US study of 14,000 college students found that today's young people are 40 percent less empathetic than college kids from 30 years ago. The research was presented at the annual meeting of Association for Psychological Science. According to one of the lead researchers, Ed O'Brien, "It's harder for today's college student to empathize with others because so much of their social lives is done through a computer and not through real life interaction." CRUSH videos are the filming of small animals like kittens, mice, hamsters and rabbits being systematically tortured by nail guns, sliced with knives, burned and finally stamped on by a woman in high heels or bare feet. The market for this sick and vile product is prodominantly in the United States. The cost to our society from animal cruelty is incalculable and our Canadian criminal code totally inadequate to deal with it. Enforcement and social services agencies have to deal with the abused human victims. Safe houses and counseling have to be made available. Families are torn apart and children traumatized. In almost 70% of the domestic violence incidents the family pets were killed or tortured in front of a family member prior to that family member being abused. Almost exlusively, no one paid any attention to the animal abuse! It can now be said that when an animal is abused humans are at risk. The media, our government justice sytem, enforcement and social sevice agencies, schools and the public must now pay strict and prompt attention. PREVENTION If you see an act of violence against any animal, report it to both the local S.P.C.A. and to the police. If you know of or suspect there is violence in a neighbor's home or a child is being abused, the perpetrator could be a future violent criminal. According to a Tufts University ground-breaking study, Animal Hoarding "involves a compulsive need to obtain and control animals, coupled with a failure to recognize their suffering... (Rescue-Hoarders) obtain animals through actively seeking unwanted pets... from animal shelters or via the Internet... misrepresenting (themselves) as a legitimate rescue, shelter, or pet hospice." Why Do People Hoard Animals? It is not clearly understood why people become animal hoarders. Early research pointed toward a variant of obsessive-compulsive disorders, but new studies and theories are leading toward attachment disorders in conjunction with personality disorders, paranoia, delusional thinking, depression and other mental illnesses. Some animal hoarders began collecting after a traumatic event or loss, while others see themselves as "rescuers" who save animals from a life on the street. One of the most perplexing facets of animal hoarding is that in the face of professed love and desire to care for animals, there can be tremendous animal neglect and suffering.... (Hoarders will) deny adverse events as obvious as starvation, severe illness and death... a desire to continue accumulation despite deteriorating conditions, is almost universal..." They have a "...resistance to adopt out animals they have "saved"... (and) the true reality of the animals' situation... boredom, fear, starvation, illness, and death... (is) met with denial or defensiveness." Hoarder's dogs generally live a life of misery, often confined in stacked cages, enclosures, or runs, 24/7, no exercise, human affection, and often living in filthy conditions. Rescue-Hoarders may claim that their dogs have problems that prevent them from being adopted out, and solicit donations for the lifetime care of these "un-adoptable" dogs in their "sanctuary." The hoarders wrongfully believe they are helping the animals by keeping them indoors. In their mind, the cats and dogs are much better off with them than if they were unclaimed outdoors. The problem is that the animals, because of their sheer number, lack proper socialization skills. In short, they're feral. Between the lack of sociability and the fact that these animals are not house-broken (defecating and urinating on the floors and furniture), the possibility of any of these animals being a candidate for adoption after rescue is nil. "It is likely that up to a quarter million animals - 250,000 a year - are victims. What explains behavior like this? Is there cruel intent behind it or is it simply a case of well-meaning people who took on too much responsibility? Are there psychological issues at play? Animal hoarding is a complex and intricate issue with far-reaching effects that encompass mental health, animal welfare and public safety concerns. Those "collected" range in species from cats and dogs to reptiles, rodents, birds, exotics and even farm animals. The following criteria are used to define animal hoarding: More than the typical number of companion animals. Inability to provide even minimal standards of nutrition, sanitation, shelter and veterinary care, with this neglect often resulting in starvation, illness and death. Individual insists all animals are happy and healthy - even when there are clear signs of distress and illness. They have numerous animals and may not know the total number of animals in their care. Their home is deteriorated (i.e., dirty windows, broken furniture, holes in wall and floor, extreme clutter). There is a strong smell of ammonia, and floors may be covered with dried feces, urine, vomit, etc. Animals are emaciated, lethargic and not well socialized. Fleas and vermin are present. Individual is isolated from community and appears to be in neglect himself. Denial of the inability to provide this minimum care and the impact of that failure on the animals, the household and human occupants of the dwelling. A person has more than a typical (often illegal) number of animals. The animals are kept indoors or inside cages in the back yard. Homes where animal hoarders live give off a very offensive odor. It's important to note that not everyone who has multiple animals is an animal hoarder. A person may have a dozen animals, and all are spayed and neutered and provided with regular veterinary care and a sanitary environment. This person would not be an animal hoarder. Even rescuers who occasionally become overwhelmed are not considered hoarders if they are actively trying to modify the situation. According to the ASPCA, there is a dire need for coordinating efforts between animal control, mental health and social workers, and public health organizations to help combat the problem of animal hoarding. This problem also requires the assistance of family members and neighbors to step up and. report suspicions of animal hoarding. Should Hoarders Be Prosecuted? In most cases, criminal prosecution of animal hoarding can be a difficult process and may not be the most effective route. Such cases are difficult to successfully prosecute and, once released, the hoarder is likely to resume collecting an excessive number of animals unless closely monitored. Some say prosecution isn't the answer because hoarders are often emotionally troubled rather than criminally inclined. "Like many psychological conditions, the causes of animal hoarding are probably multiple and, therefore, assessment of emotions, behavior and thoughts must be multifaceted to point the way toward successful treatment," says the ASPCA's Dr. LaFarge. In some cases judges can impose conditions that actually help the hoarder. They can require counseling, for instance, or ban the person from having animals. What is clear is that prosecution alone rarely alters the behavior. "It is essential that key community agencies work together to prevent animal hoarders from harming the large number of animals they gain control over," says LaFarge. "Social service agencies must collaborate with animal shelters and law enforcement to intervene to save the animals and then follow up with years of monitoring to prevent a recurrence. The general public needs to be educated to realize that the hoarder is not just a nice little old lady who 'loves too much!" The most recent hoarding in case in Canada was reported by the Winnipeg Humane Society, in which 61 dogs taken from the Judy and Peter Chernecki Gull Lake property, 90 kilometers north of Winnipeg Manitoba. Over half of the dogs seized from the filthy Gull Lake-area house that was the site of one the worst animal hoarding cases in the provinces recent memory, had to be put down. If you are a veterinarian, a social worker, animal care rescue shelter worker or a neighbor and you suspect someone is "hoarding" please report your suspicions. Take photographs if you are able to safely do so, talk to your local animal shelter, humane society, MP, MLA, the local town council, local police, your local pound or animal control officer. You could be saving the lives of both the hoarders and the animals they have. WILLFUL NEGLECT Lucien left tied up to starve to death! Passive Cruelty (Acts of Omission) The dictionary definition of the term willful is "an act that is undertaken that is of your own free will or design; done by choice; not forced or compelled." Unless someone has been diagnosed with Alzheimer's or is suffering from a mental disorder, it is not possible that an individual cannot "literally" have any knowledge or recollection of the act of bringing an animal into their care and custody and consequently just "forgetting "about them. At some point or another the recollection that there is an animal outside in the yard, tied up in pen, restrained in any manner, or kept in a room in their house, will surface. Any individual of sound reason knows full well that a sentient being (animal) requires care. Whether that care is minimal, the awareness that the animal requires food water and shelter is intermittently present. The act of choosing to ignore that awareness is an act of willfulness and therefore willful neglect. The most common situations of willful neglect are found in the thousands of animals who are bought or adopted out to individuals who take them home and then categorically ignore them and their needs. This act of passive cruelty is nowhere more evident that the thousands of dogs who are just tied up and left outside. Frequently they are left with no food or water and relatively little, if any shelter. Common signs of passive cruelty are listed below: Embedded collars Long overgrown claws or nails Chronic dental and eye infections Untreated broken bones (in any animal) Chronic tick, flea and parasite infestations (in any animal) Severe mange (in any animal) Untreated and open wounds on the body (in any animal) Patches of missing hair (in any animal) Extremely thin, starving animal (in any animal) Limping (in any animal) Dogs who are repeatedly left alone without food and water, and often chained in a yard Dogs, cats or other animals who have been hit by cars or injured in any way and have not been taken to a veterinarian Dogs or other animals (horses rabbits, etc.) who are kept outside without shelter in extreme weather conditions Animals who cower in fear or act aggressively when approached by their owners These are dogs on crown land in Churchill Manitoba belonging to Churchill resident Brian Ladoon. The dogs are chained out on lines with NO shelter NO water and fed every 2-3 days The are subject to -50 below temperatures on occasion ,polar bear and wolf attacks and eat snow for hydration. There are reportedly 200 dogs and they are there month in month out, year round ! The dogs have NO exercise and rarely any human contact. Dead dogs have been photographed on this property. This is one of the worst cases of CLASSIC passive cruelty currently existing in Canada. Other - just as common - acts of passive cruelty are committed by those individuals who have an animal and leave their place of residence, leaving the animal behind locked in a room. The long drawn out and painful suffering of any animal from willful neglect (passive cruelty) by omission is just as heinous a crime as a direct action taken to intentionally harm an animal (active cruelty) by commission. The Canadian Criminal Code that addresses animal cruelty, while pitifully out dated and inadequate, states under the section: WILLFUL ACTS AGAIN CERTAIN AND FORBIDDEN PROPERTY Cruelty to Animals Causing unnecessary suffering 446. (1) Everyone commits an offense who: (a) willfully causes or, being the owner, willfully permits to be caused unnecessary pain, suffering or injury to an animal or a bird One of the key reasons that Canada only has only a 1% animal cruelty case conviction rate, is that along with the totally inadequate legislation, lawyers do not have the required skills to determine and present active and/or passive animal cruelty case motions to the court. Judges have no idea as to how to determine a legal definition of the term willful.
